The Constitutional Court of Ecuador has notified this Friday the admission for processing by its Admissions Chamber of the lawsuit filed against the decree by which the president of the country, Daniel Noboa, temporarily entrusted the Presidency to the vice president Cynthia Gellibert for reasons of “force.” major” that were not revealed.
“The claim of unconstitutionality presented against executive decrees 494 and 500 issued by the President of the Republic, Daniel Noboa Azín, was partially admitted for processing by the First Court of the Admission Chamber of the Constitutional Court (.. .) Furthermore, the Court denied the requested precautionary measure of suspension, which had a concurring vote from Judge Jhoel Escudero Soliz,” the court reported in a statement shared through its social networks.
By Decree 500, Noboa entrusted the Presidency of the country for three days to Gellibert, whom he had appointed just five days before as vice president in charge through Executive Decree 494, “due to the temporary absence of the President of the Republic due to the circumstance of force majeure”.
The unconstitutionality lawsuit against both decrees was filed by citizen Gabriel Pereira alleging that the decree by which Noboa temporarily handed over the Presidency to Gellibert contravenes articles 145 and 146 of the state Constitution, which regulate the causes and procedures respectively. of succession in the event of cessation of functions “due to the temporary or permanent absence of the president or vice president.”
Specifically, the plaintiff refers to Decree 500 on the “cause of force majeure” used as an “act of political violence” with the objective of “undermining or diminishing the actions of the vice president of the Republic, appointed by popular election on December 15. October 2023”. It is, he adds, a “whimsical interpretation” that “seeks to circumvent the Constitution.”
This week, the president of Ecuador announced via decree (500) that he would hand over the position to Vice President Cynthia Gellibert from 5:00 p.m. (local time) on Thursday, January 9 until 4:59 p.m. on Sunday, January 12, noting that her temporary absence will be due to circumstances of “force majeure” and that, during the aforementioned period, it would not use public resources or any remuneration.
The president of Ecuador, Daniel Noboa, appointed economist Cynthia Gellibert as vice president of the country this Saturday, after the suspended vice president, Verónica Abad, announced that she will assume the Presidency and denounced that Noboa intends to carry out a coup d’état.
