The secretary general of the National Assembly of Ecuador, Alejandro Muñoz, announced this Wednesday that he has returned to the country’s president, Daniel Noboa, the decree that establishes that vice president Cynthia Gellibert, who replaces the suspended Verónica Abad, serves as head of State until Sunday, considering that it violates the Constitution.
Muñoz has justified his decision “by not complying with the provisions of articles 146 of the Constitution, 42 of the organic law of the legislative function and 30 of the Civil Code”, which establish the functions of the Vice Presidency in the event of the absence of the president, and because “what is stated in executive decree number 500 does not fit the concept of ‘force majeure or fortuitous event’.”
As noted in a written document, Noboa can request a “leave” for one month for reasons of force majeure, while it is the Assembly that can accept or deny it with the vote of the absolute majority of its plenary session. Noboa had arranged a temporary license alleging force majeure from this Thursday to Sunday to participate in the electoral campaign.
The suspended vice president had previously warned that if the presidential succession was consummated by the new vice president, Cynthia Gellibert, it would constitute a breach of the Constitution and also other laws, such as the Democracy Code.
